Terms and Conditions (T&C)
T&C
Your Terms and Conditions outline the rules for using your service. This document must clarify exactly what you're offering, what you don’t guarantee, and the client's obligations.
Key Sections for T&C:
Introduction
State that the user agrees to these terms by using your website and services.Example:
“By accessing or using Tiara Digital Services LLC, you agree to be bound by these Terms and Conditions and our Privacy Policy.”
Services Provided
Define the services you offer. Be specific about what’s included (e.g., website development, Google Ads management, call tracking) and what is not included (e.g., SEO, social media marketing).Example:
“We provide website development, Google Ads campaign management, and call tracking services for HVAC and home service companies. We do not provide SEO, social media management, or branding services.”
Payment Terms
Explain payment schedules, pricing, and client obligations (e.g., paying upfront, monthly charges).Example:
“All services are billed according to the pricing package selected by the client. Payments are due on a monthly basis. If the client chooses the setup fee model, a deposit will be required upfront.”
No Guarantees
Important: Clearly mention that you cannot guarantee specific results (e.g., number of calls, ROI).Example:
“We do not guarantee any specific results, such as the number of leads or sales generated, as marketing performance is dependent on many factors, including client participation, market conditions, and competition.”
Intellectual Property
Define who owns the work you create (e.g., websites, ads, content).Example:
“Upon full payment, all intellectual property rights to the deliverables (such as websites, ads, and designs) will transfer to the client. However, we retain the right to showcase the work in our portfolio.”
Client Obligations
Clarify what is expected of the client (e.g., timely payment, providing content, approving designs).Example:
“Clients are responsible for providing necessary information, assets, and approvals in a timely manner to ensure the completion of the project within the agreed time frame.”
Limitation of Liability
Limit your liability to protect yourself against damages beyond your control.Example:
“Our liability is limited to the amount paid by the client for the service in question. We are not responsible for any indirect, incidental, or consequential damages, including lost profits.”
Dispute Resolution
Include a clause on how disputes will be handled (e.g., arbitration, legal jurisdiction).Example:
“Any disputes will be resolved through binding arbitration in [Your State], and the prevailing party will be entitled to recover legal fees.”
Amendment
State that you reserve the right to update the terms at any time.Example:
“We reserve the right to update or modify these Terms and Conditions at any time. Clients will be notified of changes via email or through our website.”
